WellNow Urgent Care unpaid wages settlement

Three former WellNow Urgent Care staff sued in June 2023 saying the chain broke the federal Fair Labor Standards Act and the wage and hour laws of Illinois, New York and Pennsylvania. Notices went out on September 23, 2026, and hourly employees covered by the settlement have until November 25, 2026 to return a Claim Form; the court considers final approval on December 16, 2026. If you worked hourly for WellNow in one of those three states you may be eligible; the class notice puts the fund at up to $1,640,000, shared by pay periods worked. Returning the form costs nothing and the court decides the rest.

When the money moves

What the official materials say about the payment schedule for this settlement, and what the administrator has published since. Every figure below is linked to the page it was read from.

Expected

The court is due to consider final approval on December 16, 2026, and payments follow approval and any appeals.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Sears, Aguilera and Smith v. WellNow Urgent Care, P.C. · 1:23-cv-03544 · U.S. District Court, Northern District of Illinois

The class notice puts the fund at up to $1,640,000. After attorneys' fees of up to 35%, $15,000 in service payments, administration costs and payroll taxes, the rest is shared by points: one for each pay period worked as an hourly employee in the class period, two for opt-in plaintiffs. Each mailed notice carries its own estimate. Returning the Claim Form is the only route to money: taking no action releases certain state wage claims without payment. The Claim Form arrives with the mailed Notice, and a blank copy is on the settlement site's documents page.
