Guadalupe Credit Union collection lawsuit settlement

Guadalupe Credit Union has settled a New Mexico class action over collection lawsuits it filed in magistrate court without being represented by a licensed New Mexico attorney. If the credit union sued you in a New Mexico magistrate court on or after October 7, 2015 in one of those cases, you may be eligible for a payment of everything you paid it after that lawsuit was filed, plus $1,000. There is nothing to file: the settlement pays identified class members automatically unless they exclude themselves, and the last date to opt out or object is November 30, 2026, with the fairness hearing on February 3, 2027. No claim form and no fee — official claims are always free.

There is no claim form for this one. The administrator pays consumers it has already identified, so the useful step is to make sure they can reach you — not to file anything. Anyone offering to file it for you, for a fee, is selling you nothing.

Expected

The settlement site says class members need do nothing but refrain from excluding themselves, and that payment follows the court's decision. The final fairness hearing is set for February 3, 2027 at 10 a.m.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Kyle Salas, et al. v. Guadalupe Credit Union · D-101-CV-2019-02660 · First Judicial District Court, Santa Fe County, New Mexico

There is no claim form. Each class member is paid what they paid the credit union after its collection lawsuit was filed, plus $1,000 — so $1,000 is the floor and the rest depends on your own payment history. Where a collection case named more than one defendant the payment is made jointly unless another arrangement is agreed. The named plaintiffs will ask the court for $5,000 each for their work, $20,000 is set aside for administration, and attorney fees are sought separately. The court has not yet approved the settlement, so no amount is final.
