Peco Foods data breach settlement

Peco Foods, a poultry processor, has agreed to a $950,000 settlement over unauthorised access to its systems on or around December 4, 2023 that the complaint says exposed about 46,000 people's personal information, mostly current and former employees. The class is United States residents who got written notice from Peco, so if you did you may be eligible for a residual pro rata cash payment of up to $550 with no receipts, or instead up to $1,000 in documented ordinary losses or up to $5,000 for extraordinary losses and time spent, plus three years of credit monitoring. Claims close November 9, 2026 and the approval hearing is December 14, 2026. Filing on the official settlement site is free, and only the administrator and the court decide who is paid.

When the money moves

What the official materials say about the payment schedule for this settlement, and what the administrator has published since. Every figure below is linked to the page it was read from.

Expected

The notice says payments follow the December 14, 2026 final approval hearing, any appeals — which it warns can take more than a year — and the completion of claims processing.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Ryan, et al. v. Peco Foods Inc. · 63-CV-2025-900067 · Circuit Court of Tuscaloosa County, Alabama

The residual cash payment is up to $550 and needs no receipts; it is pro rata from whatever is left in the fund, so the real figure depends on how many valid claims arrive. Instead of it a class member may claim up to $1,000 in documented ordinary out-of-pocket losses, or up to $5,000 for extraordinary losses and attested time at $40 an hour for up to ten hours. Those options need reasonable documentation and an attestation under penalty of perjury. Three years of three-bureau credit monitoring is offered as well. All figures are estimates from the notice.

Where the settlement fund goes

A $950,000 settlement fund, from which the notice says notice and administration costs, the attorneys' fee award, service awards and the documented loss claims come before the residual pro rata payments are worked out.

Why this case happened

Peco Foods is a poultry processor. The lawsuit concerns unauthorised access to its systems on or around December 4, 2023 that the complaint says exposed the personal information of about 46,000 people, mostly current and former employees. Peco denies the claims and the court has not decided them.

Eligibility questions

These questions help you decide whether to read the official notice. They are not a legal determination.

Did Peco Foods send you written notice that your personal information may have been compromised in its data breach?

Most of those affected are current and former Peco Foods employees.

Do you have documentation for money you spent or lost because of this data breach?

Documents are needed only for the larger reimbursement options; the residual payment asks for none.
