Nemours Foundation retirement plan settlement

The Nemours Foundation has agreed to pay $2,275,000 to settle an ERISA case in the Middle District of Florida over its retirement plans. If you were a participant in or a beneficiary of The Nemours Foundation Section 403(b) Plan or the Pediatric Medical Services of Florida, Inc. 401(k) Plan at any time between January 1, 2017 and December 31, 2025, you may be eligible for a share of what is left after court-approved fees, costs and expenses, worked out from your average account balance under a plan of allocation the court has still to approve. There is no claim form and nothing to pay anyone — the administrator works from the plans' own records. Objections are due February 22, 2027, the fairness hearing is March 23, 2027, individual amounts will not be known for months after that, and only the administrator decides who is paid.

There is no claim form for this one. The administrator pays consumers it has already identified, so the useful step is to make sure they can reach you — not to file anything. Anyone offering to file it for you, for a fee, is selling you nothing.

Expected

The notice says individual amounts will not be known for a number of months after final approval, and that payment follows the court's approval of a plan of allocation and the resolution of any appeals. The fairness hearing is set for March 23, 2027.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Eligibility questions

These questions help you decide whether to read the official notice. They are not a legal determination.

Were you a participant in or beneficiary of a Nemours Foundation 403(b) plan or the Pediatric Medical Services of Florida 401(k) plan between January 1, 2017 and December 31, 2025?

Predecessor and successor plans are included in the class definition.

Have you since moved that money out of the plan, by rollover or withdrawal?

Former participants are still in the class; the notice says no action is needed to be paid.
