EFS Advisors and Aviben data security incident settlement

EFS Advisors and Educators Benefit Consultants, which trades as Aviben, detected an intruder on their network on or around February 22, 2024. If your private information may have been exposed, you may be eligible for money from this Minnesota settlement: a flat $50 cash payment that asks for no paperwork, or reimbursement of up to $2,500 for documented out-of-pocket losses, plus a year of three-bureau credit monitoring either way. Claims close October 22, 2026, and the court considers final approval on November 6, 2026. Filing on the official settlement site is free.

Expected

The notice says cash benefits and credit-monitoring activation are issued only after the court approves the settlement and that approval becomes final.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Kennedy, et al. v. EFS Advisors, LLC, et al. · 30-cv-24-649 · Isanti County District Court, Minnesota

There are two cash options. The basic one is a flat $50 alternative payment that needs no paperwork. Instead of it you may claim up to $2,500 for documented out-of-pocket losses traceable to the incident, which does need supporting records. Either way a valid claim can also take one year of three-bureau credit monitoring with at least $1 million of identity-theft insurance. The defendants pay no more than $850,000 in total and individual cash payments are cut pro rata if approved claims exceed that cap, so these are estimates and are not guaranteed.
