Carruth vendor data breach settlement for Seattle and Federal Way schools staff

Seattle Public Schools and Federal Way Public Schools settled a claim over a December 2024 cyber incident at Carruth Compliance Consulting, the districts' third-party retirement plan vendor. The class is everyone whose personal information the districts had given to Carruth and that was compromised in the breach Carruth disclosed in January 2025. A non-reversionary $300,000 fund pays either documented out-of-pocket losses up to $5,000 or a pro rata cash payment of up to $599, which the notice warns is likely to come to less; the deadline is December 2, 2026. Filing on the official site is free, and the final fairness hearing is set for December 18, 2026.

Expected

The court is due to hold its final fairness hearing on December 18, 2026, and the notice says claims are paid after the settlement is approved. No payment date is published.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Fitch, et al. v. Seattle Public Schools and Federal Way Public Schools · 25-2-04060-7 SEA · Superior Court of Washington, King County

Two options come out of a non-reversionary $300,000 fund: documented out-of-pocket losses up to $5,000 a person for expenses incurred on or after December 19, 2024, or a pro rata cash payment of up to $599. The notice says that cash payment may come to less than $599, and that all payments are cut back proportionally if claims, administration costs, service awards and fees would exceed the fund. The claim form builds in the browser, so whether it asks for an identifier from the mailed notice could not be read. Amounts are estimates, not guarantees.
