State attorney-general restitution · Open
Texas Real Estate Recovery Trust Account for uncollectible judgments against licensed agents
Texas keeps a Real Estate Recovery Trust Account for people who won a civil judgment against a TREC-licensed broker, sales agent, or easement or right-of-way agent and cannot collect it because the license holder refuses or is unable to pay. You may be eligible if that judgment rests on conduct the Texas Real Estate License Act prohibits; the application is filed with the court that entered the judgment, under the same cause number. TREC caps payment at $125,000 arising out of a single transaction and $250,000 in total against any one license holder, and the court decides what is actually paid, so no amount is certain. TREC's forms are free to download and submit, and no service needs to be paid to apply.

Covered products and services
- Transactions handled by a TREC-licensed real estate broker or sales agent
- Work by a TREC-licensed easement or right-of-way agent
TREC caps payment at $125,000 arising out of a single transaction and $250,000 in total against any one license holder, so a judgment larger than that is only partly covered. The court that entered the judgment decides what is paid out of the account, and figures here are estimates rather than a promise of any amount.
