Texas Retina Associates data incident settlement

Texas Retina Associates reported a data incident in April 2024 and mailed notices on or about June 28, 2024 to patients whose names, Social Security numbers, medical record numbers and health insurance details may have been exposed. If you received that notice you may be eligible for a $45 cash payment with no documents, or up to $4,000 for documented out-of-pocket expenses, and either way you may elect three years of identity theft protection with $1 million of insurance. Claims close on November 30, 2026, and both the online and paper forms need the Class Member ID and PIN printed on the notice. Filing on the official settlement site is free.

Expected

The notice sets a final fairness hearing for December 3, 2026 and publishes no distribution date, so payment timing turns on approval and any appeals.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Covey, et al. v. Texas Retina Associates, et al. · DC-24-09642 · District Court of Dallas County, Texas, 101st Judicial District

The notice offers a $45 cash payment with no documents, or reimbursement of documented out-of-pocket expenses up to $4,000 for costs incurred between March 27, 2024 and November 30, 2026 — bank fees, phone and data charges, postage, local travel, and credit monitoring bought because of the incident. Separately, any class member may elect three years of identity theft protection including $1 million of insurance, with no documents needed. Amounts are what the notice allows, not what any claim is guaranteed.

Eligibility questions

These questions help you decide whether to read the official notice. They are not a legal determination.

Did Texas Retina Associates mail you a notice, around June 28, 2024, about its data incident?

The class is the people the practice notified after the April 2024 incident.

Did you pay for credit monitoring, replacement documents or other costs because of the incident?

Only the documented-loss option needs receipts; the $45 payment does not.

Are you the judge presiding over this case, or a member of that judge's staff or family?
