Progress Residential eviction attorneys' fee settlement

Progress Residential has settled a Seminole County, Florida class action over the eviction attorneys' fees it charged tenants in the four years before August 26, 2024. There is no claim form: if the company's records show you paid those fees you may be eligible for an automatic payment, mailed after the court approves the settlement — 75 percent of what you paid if you ended your tenancy owing Progress less than those fees, or 30 percent if you ended it owing more. Tenants who were assessed the fees but never paid them get those claims released instead. The last date to opt out or object is November 20, 2026 and the approval hearing is January 11, 2027. Nothing here costs a class member anything; official claims are always free, and keeping a current address with the administrator is the only step worth taking.

There is no claim form for this one. The administrator pays consumers it has already identified, so the useful step is to make sure they can reach you — not to file anything. Anyone offering to file it for you, for a fee, is selling you nothing.

Expected

The settlement site says an eligible class member need do nothing and that a settlement payment will be mailed after the court approves the settlement. The final approval hearing is set for January 11, 2027.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Crystal Johnsten, et al. v. Progress Residential, LLC, et al. · 2024-CA-001692 · Circuit Court of the Eighteenth Judicial Circuit, Seminole County, Florida

There is no claim form. Paid Class members — tenants who ended their tenancy, or remain tenants, owing Progress less than they paid in eviction attorneys' fees — receive 75% of the fees they paid. Balance Class members, who ended their tenancy owing more than they paid in those fees, receive 30%. The Attempted Collection Class, assessed the fees but never charged with paying them, receives a release of those claims rather than money. The defendants separately pay $300,000 in attorneys' fees and costs. Payments are mailed only after final approval, so no amount is final yet.
