Equinox, Inc. data incident settlement

Equinox, Inc. — the Albany, New York health and human services provider, not the fitness clubs of the same name — has proposed a settlement over a data incident it became aware of on or about April 29, 2024, in which names, dates of birth, Social Security numbers, driver's license numbers, health insurance details and medical and medication information were accessed. If you live in the United States and Equinox sent you a notice saying your information may have been affected, you may be eligible to claim. The basic option is a pro rata cash payment estimated at about $100 and asks for no paperwork at all; separately you can claim up to $5,000 for documented out-of-pocket losses, and three years of credit monitoring. Claims close October 23, 2026, and filing on the official settlement site is free.

Expected

The notice says no benefits are provided unless the court approves the settlement and it becomes final. The final approval hearing is set for November 12, 2026, and credit monitoring activation codes go out within 30 days of the effective date.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

McHugh v. Equinox, Inc. and Carter v. Equinox, Inc. · 911677-24 and 901198-25 · Supreme Court of the State of New York, Albany County

Three benefits, and they can be combined. A pro rata cash payment estimated at about $100, which asks for no documentation and moves up or down with the number of valid claims. Reimbursement of up to $5,000 for documented out-of-pocket losses tied to the incident — credit monitoring bought on or after April 29, 2024, unreimbursed fraud losses, bank fees, postage, mileage — which does need documentation. Plus three years of one-bureau credit monitoring with up to $1,000,000 of identity theft insurance. The notice gives no total fund figure, so every amount is an estimate.
