Concord Management security deposit settlement

Concord Management has settled two Florida class actions over security deposits it withheld and lease termination fees it charged. If you rented from Concord in Florida between April 3, 2021 and April 3, 2025 and part of your deposit was kept, you may be eligible for a share of a $1,850,000 fund, worked out in proportion to the deposit money held back; the settlement also waives more than $15,985,000 in claimed balances and requires negative credit tradelines to be deleted. There is nothing to file and nothing to pay anyone — the administrator mails checks automatically, within 45 days of final approval, to class members who do not opt out by November 20, 2026. The fairness hearing is December 3, 2026, amounts are estimates, and only the administrator decides who is paid.

There is no claim form for this one. The administrator pays consumers it has already identified, so the useful step is to make sure they can reach you — not to file anything. Anyone offering to file it for you, for a fee, is selling you nothing.

Expected

The notice says checks are mailed within 45 days of final approval. The fairness hearing is set for December 3, 2026, and nothing is paid until the court approves the settlement and any appeals are resolved.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

Jay Alan Durrance v. Concord Management Ltd., et al. · 2023-CA-003292 · Circuit Court of the Eighteenth Judicial Circuit, Seminole County, Florida

A $1,850,000 fund. There is no claim form: the administrator pays each class member a pro rata share based on the ratio of that member's withheld deposit to the class total, so the amount turns on how much was held back. The notice says class members whose deposits came back in full receive the other benefits but no check. Separately, the settlement waives more than $15,985,000 in balances the defendants claimed and requires negative tradelines to be deleted from credit reports. Every figure is an estimate until the court approves the settlement.

Why this case happened

The complaint says Concord sent security deposit deduction notices in a form that did not meet the Florida Residential Landlord and Tenant Act, withheld or mishandled deposits, and charged liquidated-damages lease termination fees it was not owed. A companion case, Marlene Barban v. Concord Management Ltd., No. 2022-CA-009410-O in the Ninth Judicial Circuit for Orange County, is settled alongside it. The defendants deny the allegations and the court has not ruled on the merits.

Eligibility questions

These questions help you decide whether to read the official notice. They are not a legal determination.

Did you rent a home in Florida from Concord Management between April 3, 2021 and April 3, 2025?

The class covers residential tenants of the Concord settling parties in that window.

Was part of your security deposit kept, or were you charged a lease termination fee when you moved out?

The class also covers tenants sent a deduction notice in the form the case challenges.

Does Concord, or a debt collector acting for it, say you still owe money on that tenancy?

The settlement waives those balances and asks the credit bureaus to delete the tradelines.
