Chimienti & Associates data breach settlement

Chimienti & Associates has agreed to a $650,000 settlement over a March 2024 cyberattack that the complaint says reached names, Social Security numbers, dates of birth, state ID numbers, financial account details and health information. If you were notified that your information was involved, you may be eligible for a pro rata cash payment of up to $100 with no receipts, or up to $5,000 for documented out-of-pocket losses, plus two years of credit monitoring. Claims close December 28, 2026 and the court considers final approval on January 12, 2027. Filing on the official settlement site is free.

Expected

The notice sets a final approval hearing for January 12, 2027. No payment date is published, and cash payments are pro rata.

Read off the official notice, in its own words. These dates slip — an appeal can move a distribution by a year or more — so treat it as the administrator's plan rather than a schedule.

David Fonseca v. Chimienti & Associates · VCU315048 · Superior Court of California, County of Tulare

Either a one-time pro rata cash payment of up to $100 with no receipts, or reimbursement of up to $5,000 for documented out-of-pocket losses incurred between March 22, 2024 and December 28, 2026. Every class member may also enroll in two years of CyEx Financial Shield Complete monitoring. The fund is $650,000 and cash is paid pro rata, so $100 is a ceiling and an estimate, not a promise. The online form needs the LoginID and PIN printed on the mailed notice; a printable claim form is published for mailing instead.

Where the settlement fund goes

The FAQ says Chimienti agreed to create a $650,000 settlement fund, out of which the alternate cash payments are paid pro rata.

Why this case happened

The complaint concerns a March 2024 cyberattack on Chimienti & Associates. The settlement site says the information involved may have included names, Social Security numbers, dates of birth, state-issued identification, financial account information and health information. Chimienti has not admitted the claims and the court has not decided them.

Eligibility questions

These questions help you decide whether to read the official notice. They are not a legal determination.

Were you told your information was involved in the March 2024 Chimienti & Associates data incident?

The class is people whose private information was impacted in that incident.

Do you have receipts or bank statements for money you spent or lost because of the breach?

Documented losses can be reimbursed up to $5,000. The flat option needs no proof at all.

Do you still have the mailed notice with your LoginID and PIN on it?

The online form needs both. Without them you can ask the administrator for a paper form.
